RALEIGH, (SGRToday.com) - Attorney Gene Boyce has not prevailed in his attempt to force the State Bar to investigate his complaint against Democratic gubernatorial candidate Roy Cooper over an incident that occurred in Cooper's 2000 campaign for Attorney General.

Judge Donald Stephens dismissed the case last week.

Boyce's son Dan lost to Cooper.

In that race, Cooper ran an ad that made claims about excessive attorney fees charged by Boyce. The elder Boyce pursued a claim over the ad for years, saying it was false.

The case was settled in 2014. WRAL reported that the settlement included Cooper paying $75,000 and issuing a written apology.
