N.C. Court Of Appeals Reverses Trial Court In Cleveland County Charter School Case PDF Print E-mail

RALEIGH, (SGRToday.com) - It is back to the trial court for a dispute involving Cleveland County public charter schools. On Tuesday the North Carolina Court of Appeals reversed the lower court's decision in Thomas Jefferson Classical Academy Charter School v. Cleveland County Board of Education.

 
A three-judge panel of the full appeals court was unanimous in its ruling.
 
The decision, which relates to a funding dispute, reversed a trial court’s decision that would have forced the Cleveland County school system to pay more than $100,000 to three charters in the county.
 
The lower court will now use a different standard to determine what amount should be awarded to the schools. $57,000 was the original number. 
 
In addition, the Court of Appeals ruled the charters are not entitled to $47,000 in attorneys' fees they had been awarded.
